MONEY CLAIM ONLINE DOESN’T WORK!
Filling in the Money Claim Online forms (MCOL) is a simple process, but is it effective? The County Court Business Centre Northampton deals with money claim online submissions but there are better ways to recover your money.
If the debtor ignores your money claim, you can go to a Small Claims Court or County Court to get a default County Court Judgement, but this does not get you your money back. This will get you a piece of paper from a man in a wig confirming you are owed money, that’s all!
High Court Writ
Even if you have a high court writ you will still need a court bailiff or enforcement agents to advance your money claim. High court enforcement officers are sent specifically by the high court but in our experience are less effective than our debt collectors. In fact, they are often far less successful, as they do not persist like we do.
Small Claim Court Process
The small claims court procedure means that for smaller debts you can be waiting a long time and incur small claims court fees. We recently dealt with a case that went through a small claims court in Scotland. By the time we were called in the debtor had very little money or assets and the recovery process was much more arduous than it need be.
It would cost many hundreds and thousands of pounds to win your case especially if a defence is put in and YOU DO NOT GET YOUR COSTS BACK.
Are You Thinking Of Taking Your Debtor To A Small Claims Court Court? Don’t!!!
Once you have your piece of paper you then need to give it to a debt collector, don’t expect the courts to do this for you. We’ve all seen programmes like ‘Can’t Pay We’ll Take It Away’ where enforcement agents are sent to recover debts – often many months or even years after the debt started! Don’t waste time!
If you hand it to a county court bailiff, you will get a 60 year old man in a van that will earn around £20k per year asking your debtor to pay in instalments. The bailiff is not financially motivated to get your debt recovered and whether he collects £20 or £200k he will still get a £20k salary and his little white van.
This will have your debtor laughing at you even more.
You do not need a CCJ to collect your money!
Writing letters and making telephone calls does not generally work, you will have done all that, so you don’t need to do it all again with that piece of paper in your hand. Waiting for a CCJ to collect your money just delays the process, adds court fees and delays the whole debt collection process.
